Full Terms of Business

 

These Terms of Business explain the basis on which I will carry out the work necessary in relation to your work The explanation is based upon what I know so far, upon the basis of what you have told me.

1.   People responsible for your work

Your work will be carried out by myself, Julian Taylor, a Notary Public.  If you need to telephone me and I am unavailable please leave me a message and I will get back to you as soon as possible.

 

I will ensure you are kept informed about any developments in your case, but if you have any queries or if you are unclear about any of the procedures that I will be undertaking on your behalf, or you simply want more information, please contact me.

 

If you have a comment to make, or if you are unhappy about any aspect of my service, please let me know.

2.   Charges and Expenses

​

If you provide the paperwork and I have no documentation to prepare, I will work on a fixed price basis.  The  minimum  charge is £75.00.

 

If you have  multiple documents or what is required is more time consuming or substantial  then your  work will  be carried out on a time costed basis at the rate of £175 per hour. This will include seeing you, any advice and preparation attendances upon you phone calls and correspondence  

 

Preparation  includes: the  drafting of documents; checking with your lawyers for any special requirements or formalities that they need to have observed; resolving issues with missing data and contact with any third party to verify facts or  documents and any further investigative work; any time spent travelling and attending to legalisation.    Routine correspondence and telephone calls made and received will be charged as 1/10th of an hour.

 

In addition I will pass on to you the cost of any expenses that I incur for you such as legalisation fees. courier and translation fees and the cost of any documents or information I obtain for you. If this becomes necessary then I will discuss this with you and inform you of the likely cost.

 

I will update any estimate as and when needed and will inform you in advance if it appears that the original  estimate may be exceeded for instance  if any unforeseen or additional work becomes necessary.

 

If for any reason this matter does not proceed to completion, I will charge you for work done and any expenses incurred.

 

I may request payments on account for charges and expenses to be incurred as your matter progresses.  These payments will be set against your final bill but it is important that you understand that the total charges and expenses may be greater than your advance payments.

 

3.   Billing arrangements and payment

Payment of your bill  is due straight away. Please see the attached advice as to how payment can be made. Please note that payment must be made before your documents are released.

 

If you have any query about your bill, you should contact me straight away.

 

3.   Confidentiality and data protection

​

In the course of acting for you I will obtain process and store data and personal information.  I will only do so  in accordance with the attached Privacy Policy.

 

I have Regulatory duties to make disclosures to the authorities to prevent Money Laundering,  and the Financing of Terrorism.

 

5.   Legal advice

​

Notarial services are not a substitute for taking legal advice from your own lawyer.  I will not provide you with any advice about the documents that I notarise for you that have been provided by a third party unless it is made clear in these terms of business that I have agreed to do so.   It is therefore important that you satisfy yourself that such documentation is complete, accurate, and that you are aware of the  obligations it creates for you.

 

6.   Storage of papers and documents

​

In the future, if you ask me to retrieve papers or documents from storage in connection with your affairs, I may make a charge based on the time spent producing those  papers or documents for you.  I will also charge for reading, corresponding or other work necessary to comply with the instructions given by you or on your behalf.

 

7.   Termination

​

You may terminate your instructions to me at any time, but I will be entitled to keep all your papers and documents whilst there is money owing to me for my charge and expenses.

8.   Communication between us

​

I am confident that I will provide you with a high quality service in all respects.  If however you are unhappy about my work or your bill, please raise this with me because I value your instructions and would not wish to think you were unhappy with my service.   Please also  see the attached Complaints Procedure.

 

9.   Insurance

​

In the  event that a mistake is made, I have professional indemnity insurance in the sum of £1m per claim.  It is a condition of my acceptance of your instructions that you limit any claim you may have  against me to the amount of that sum and  that our agreement is subject to English Law and determination only by the English Courts.
